Service Terms and Conditions
These Service Terms and Conditions (these “Terms”) set forth the terms governing Provider’s provision of the Services described on the Statement of Legal Aid and invoice that are hereby incorporated into the Agreement.
This statement of Legal Aide Services and the Service Terms and Conditions attached hereto (collectively, the “Agreement”) is entered into by and between the client specified in the Statement of Legal Aid (“Client”) and (“Provider”). Any capitalized terms used but not defined in this Statement of Legal Aid have the meaning set forth in the Service Terms and Conditions.
Accepted and agreed by their duly authorized representatives of the parties as of the Effective Date.
Legal Document Preparation Services:
Client is obtaining legal document preparation services from EAP, not any particular attorney, and/or attorney services will be provided to Client. All documents will be created by EAP and EAP will collect additional information to complete client's case filing. EAP is responsible in submitting cases to the appropriate departments and providing records to client of proof of filing. EAP will be the main point of contact between the court and the client. Any response a client may need for the court EAP will be responsible to respond at no cost.
Legal Aid Services Provided
Pardon: Assistance of completing an application to submit for a Governers Pardon, this includes interview with client, reference letters, application assistance, obtain copy of original case files, fingerprint request, criminal background copy and assistance with personal declaration.
Expungement / Seal / Early Termination: Assistance with reopening case to have the case review by the court to resentenced client either to dismissal or lessen charges.
Divorce/Evictions/Civil Complaints:
DELEGATION OF SERVICES. Client understands that EAP includes there are various legal professionals, that may be utilized in the proceedings involving Client's case. Client further understands that support personnel from EAP may also do work in connection with Client's case.
CONDITIONS. This agreement will not take effect, and EAP will have no obligation to provide legal aid services, until Client pays the fee required by Paragraph 7 of this agreement. Once filing fee is paid, client is agreeing to this agreement.
Additional Terms:
All cases are subject to approval by the court not by our organization. We prepare your documentation and we at no point guarantee or are in control of when you case will be heard. Depending on your case and your history the case will be investigated by the court and moved forward according to their cases.
SERVICES AND COMPENSATION.
Provider will provide the services specified in the Statement of Legal Aid (“Services”) to Client on the terms and conditions specified in these Terms. Client will pay Provider the fees in the amount and frequency specified in the invoice sent to client prior to starting any case filing. All fees paid under this Agreement are non-refundable, unless otherwise expressly specified in these Terms or the Statement of Work. Full filing fee must be paid to begin legal services. If you have a payment plan once your final payment is made your case will begin to be prepared for filing. There are no refunds at any point, after the 1st payment is made and records has already done a background check on client.
EXTRA COSTS. EAP may incur various costs and expenses in performing legal services under this agreement.
RESPONSIBILITIES OF LAW FIRM AND CLIENT. EAP will perform the legal aid services called for under this agreement, keep Client informed of progress and developments, and respond within a reasonable time to Client's inquiries and communications. Client will be truthful and cooperative with EAP, provide on a timely basis all information and documents necessary to EAP's effective assistance of Client's interests, keep EAP reasonably informed of developments and of Client's address, telephone number, and whereabouts, timely make any payments required by this agreement and abide by this agreement. Client should keep in mind that EAP's ability to adequately prepare Client's legal documents is dependent upon Client keeping EAP fully informed.
CLIENT OBLIGATIONS.
Client will provide EAP with true and correct information to allow EAP to perform the Services. Additionally, Client will allow necessary time to obtain any information to complete any filing, which may include obtaining court records, criminal records, probation reports, police reports or statements from other parties. If Client can obtain required information, Client will promptly notify Provider. Client agrees to conduct in a professional manner at all times and will not commit acts that will be considered harassment, slander or unethical towards anyone associated with the client's file. Client understands that that this is a professional agreement, and complaints can be filed in the court of law if there is a disagreement in the services provided. EAP will do whatever it is capable of doing to successfully file clients court documents to the court and client understands that the court is the sole descion maker on clients filing. If client is to breach this obligations EAP has the right to withdraw from assistance with clients file due to the conduct of client's behavior. This includes, harassing, threaten, cyber stalking, slandering, placing damage comments or reviews on the internet. Disputing fees after case has been filed. Calling or texting any EAP legal professional regarding unrelated subjects. Accessing calling, email, or texting. Client agrees to act according to standards of a professional business relationship. In no way should EAP legal professionals feel uncertain during the assistance of clients document preparation.
WITHDRAWAL OF LEGAL AID ASSISTANCE.
EAP may withdraw at any time as permitted under the Rules of Professional Conduct of the State Bar of California. The circumstances under which the Rules permit such withdrawal include, but are not limited to, the following: (a) Client consents to withdrawal, (b) Client's conduct renders it unreasonably difficult for firm to carry out the services effectively, or (c) Client fails to pay' fees or costs as required by his or her agreement with EAP. Notwithstanding EAPs withdrawal, Client will remain obligated to pay the agreed fee for services provided, and to reimburse EAP for all costs advanced, before the withdrawal.
Postponing or Cancellation.
If not set forth in the Statement of Legal Aid, any postponing or cancellation of the Services will be subject to EAP’s postponing or cancellation policy. If you would like to place your case on postpone because of another legal matter, this can be requested but no refund will be given.
DISCLAIMER OF GUARANTY.
Although EAP may express an opinion about possible results regarding the outcome of Client's matter or specific time of case completion, EAP cannot guarantee any particular result. Client acknowledges that EAP has made no promises about the outcome and that any opinion offered by EAP in the future will not constitute a guaranty.
ERRORS & OMISSIONS COVERAGE.
Law Firm maintains errors and omissions insurance in excess of the amount required by California law.
